1. Acceptance of these terms
These Terms and Conditions (the "Terms") govern your use of Analyse8 (the "Service"), an AI-powered marketing analytics product. The Service is operated by Spresso Studio ("Spresso Studio", "we", "us", or "our"), a sole proprietorship based in Mumbai, India.
By creating an account or otherwise using the Service, you agree to these Terms. If you are using the Service on behalf of an organisation, you confirm that you have the authority to agree to these Terms for that organisation. If you do not agree, please do not use the Service.
2. The service
Analyse8 lets you connect supported marketing data sources and ask questions about your data in a chat, generate reports, and export or share the results. We currently support Google Analytics, Google Ads, Google Search Console, Meta Ads, Facebook Pages, and Instagram professional accounts, with more integrations planned over time.
Analyse8 is an actively developed product. Features may be added, changed, or removed, and some may be offered on a trial or beta basis.
3. Your account
To use most features, you need an account. You agree to provide accurate information and to keep it up to date. You are responsible for activity that happens under your account and for keeping your login credentials secure. Please tell us promptly if you believe your account has been used without your permission.
3.1 Team members
If your plan allows you to invite other people to your account, the person who owns the account (the "account owner") is responsible for everyone they invite and for the actions those members take within the account. Invited members act within the account owner's account, under these Terms, and can access only the projects they have been granted access to. The account owner is responsible for managing member access and for removing members who should no longer have it.
4. Connected accounts and authorisation
The Service works by connecting to third-party data sources that you choose, such as Google Analytics, Google Ads, Google Search Console, Meta Ads, Facebook, and Instagram. By connecting an account, you confirm that:
- You own that account, or you have permission from its owner to access and use its data through the Service.
- Your use of the connected data complies with the terms of the relevant third-party service, including Google's and Meta's terms and policies.
- You will disconnect any source you are no longer authorised to access.
We access data from your connected accounts only to provide the Service to you, as described in our Privacy Policy. Across every connected source, we only ever access your data to read it. We do not create, edit, or delete anything in your connected accounts.
For Google Analytics and Google Search Console, we request read-only access scopes. Google Ads does not offer a read-only scope, so the broader Google Ads access scope is requested at the point of authorisation. Even so, the Service only reads your Google Ads data and never makes any changes to your Google Ads account. For Meta Ads, Facebook, and Instagram, we request only the permissions needed to read your ad, Page, and Instagram data, and we never post, publish, edit, or delete anything in your Meta accounts. You remain responsible for the accounts you connect and for the permissions you grant.
5. Plans, credits and projects
The Service is offered on a Free plan and on paid plans (currently Pro and Business). Each plan includes a set number of credits, projects, and data sources. A credit is used when you ask a question or generate a report, and a project is a workspace for a connected site, brand, or client. Some features, such as public shareable report links and scheduled reports, may be available only on certain plans. The specific allowances and features for each plan are shown on our pricing page and may be updated from time to time.
Where a plan is described as offering "unlimited" usage, this is intended for normal, good-faith use of the Service and is subject to our fair usage policy. We may apply reasonable limits to prevent abuse, protect the Service, or address usage that is excessive or automated in a way that harms other users.
6. Payment and billing
Paid plans are billed in advance on a recurring basis (for example, monthly) in US dollars, through our third-party payment processor. By subscribing to a paid plan, you authorise us to charge your chosen payment method for each billing cycle until you cancel.
You are responsible for any taxes that apply to your purchase, unless we are required to collect them. We may change our prices, and we will give you reasonable notice of any change before it affects you.
7. Cancellation and refunds
You can cancel a paid plan at any time from your account. When you cancel, you keep access to your plan's features until the end of your current billing period, after which your account moves to the Free plan. There is no lock-in and no cancellation fee.
Except where required by law or stated otherwise in our Refund Policy, payments already made are non-refundable, including for partially used billing periods.
8. Acceptable use
When using the Service, you agree not to:
- Use it for any unlawful purpose or in breach of any applicable law or regulation.
- Connect or access data you do not own or have permission to use.
- Attempt to gain unauthorised access to the Service, other accounts, or our systems.
- Copy, resell, sublicense, or commercially exploit the Service except as expressly allowed.
- Reverse engineer, decompile, or attempt to extract the source code of the Service.
- Interfere with or disrupt the Service, or introduce malware or harmful code.
- Use automated means to access the Service in a way that places unreasonable load on it.
9. Intellectual property
The Service, including its software, design, branding, and content (other than Your Content), is owned by Spresso Studio and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable right to use the Service in line with these Terms.
These Terms do not transfer any ownership of the Service to you. The name Analyse8, the Spresso Studio name, and related logos may not be used without our prior written permission.
10. Your content and privacy
You keep all rights to the data you connect and the reports you generate ("Your Content"). You grant us a limited licence to access, process, and store Your Content only as needed to operate and provide the Service to you.
How we collect and handle personal data is described in our Privacy Policy, which forms part of your use of the Service. Please review it to understand our practices.
11. Third-party services
The Service relies on third-party services, including Google's and Meta's APIs and our payment processor. Your use of those services may be subject to their own terms, and we are not responsible for their availability, accuracy, or any changes they make. If a third-party service changes or becomes unavailable, some features of Analyse8 may be affected.
12. Availability and changes
The Service is provided on an "as is" and "as available" basis. We work to keep it reliable, but we do not guarantee that it will be uninterrupted, secure, or error-free. We may modify, suspend, or discontinue all or part of the Service at any time, and we will try to give reasonable notice of significant changes where we can.
13. Disclaimers
Analyse8 uses AI to generate answers, insights, and reports from your data. While we work to make these helpful, they may contain errors or omissions and should not be relied on as professional, financial, legal, or tax advice. You are responsible for any decisions you make based on the Service. To the fullest extent permitted by law, we disclaim all warranties not expressly stated in these Terms.
14. Limitation of liability
To the fullest extent permitted by law, Spresso Studio will not be liable for any indirect, incidental, special, or consequential losses, or for any loss of profits, revenue, data, or goodwill, arising from your use of the Service.
To the extent we are found liable, our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the twelve months before the event giving rise to the claim.
15. Indemnification
You agree to indemnify and hold Spresso Studio harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your misuse of the Service, your breach of these Terms, or your use of data you were not authorised to access or connect.
16. Termination
You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if needed to protect the Service or other users. On termination, your right to use the Service ends. Sections that by their nature should survive termination (such as intellectual property, disclaimers, limitation of liability, and governing law) will continue to apply.
17. Changes to these terms
We may update these Terms from time to time. If we make material changes, we will take reasonable steps to let you know, such as by email or a notice in the Service. The "Last updated" date at the top shows when the Terms were last revised. By continuing to use the Service after changes take effect, you agree to the updated Terms.
18. Governing law
These Terms are governed by the laws of India. You agree that the courts of Mumbai, Maharashtra will have exclusive jurisdiction over any dispute arising from or relating to these Terms or the Service.
